Terms of sale

This document regulates the conditions of sale for purchases made on the website www.exporta.it which are concluded by email

Before making any purchase, customers must register on the Exporta website and accept the following conditions of sale.

Accountability

Exporta is not responsible for any damage or loss, direct and/or indirect, deriving from the sale of the items proposed by email offers, also for delayed and/or non-delivery of the product,nor for any other fact not directly attributable to our company. Many of the products offered to customers will be available in about 7-10 days from the date of confirmation of the customer’s order, even if not directly specified.

Exporta takes no responsibility for loss of items after delivery.

Technical Informations

The technical informations included in the Exporta website are obtained from the informations published by the manufacturer of the items included in our catalog.

Exporta, therefore, reserves the right to modify/adapt the technical informations of the products in the catalog, even without prior notice.

Booking

For bottles proposed as “in reservation” is required the payment of 50% of the amount at the time of confirmation of the order.

In case Exporta should not be able to provide the bottles within the terms indicated, Exporta will refund the sums received as deposit, excluding any other claim.

Warranty on bottles

Exporta strives to the maximum of its skills to carry out all the necessary checks in order to guarantee the conformity and optimal storage conditions of the bottles,and if there are defects regarding the wear of the labels,capsules or other,communicates it to the customer in time also by sending photographic material.

In any case, the contents of the bottles or the drinkability of the same are not guaranteed.

The customer if not satisfied with the bottles received can take advantage of the right of withdrawal ( see section right of withdrawal ) as long as the bottle has not been uncorked and/or damaged in any of its parts.

Any dispute concerning the authenticity of the bottles must be communicated to Exporta within the peremptory period of two weeks from receipt of the goods by registered mail or certified mail ( exporta@pec.it ) accompanied by relative expertise

After this period ceases all responsibility of the Exporta

If the dispute is considered founded, the customer must return the bottle/s object of the dispute to Exporta in the same conditions in which they were received by the customer and after that Exporta will proceed to the refund of the amounts paid,excluding any other claim.

Prices

The prices of the products communicated are inclusive of VAT at 22%

VAT deductibility

Some of the bottles proposed come from important private collections,for these bottles VAT is not deductible.

Exporta also does not issue documents intended for applying VAT refund.

Purchase and payments

The purchase of wines, like all spirits, is only allowed to those over 18 years old.

The customer agrees to be 18 years old at the date of the order.

The ordered items must be paid in advance through one of the payment methods provided :

Paypal (with the addition of 3.5% commissions)

for amounts up to a maximum of 3000 euros

Bank Transfer

Please remember to make payment within 3 business days,once the order is confirmed.

Subscriptions to offers / promotions and Wine Boxe

Customers who have subscribed to one of our offers can unsubscribe at any time.

The amount of the subscription relating to goods already shipped, received and accepted by the customer is not refundable.

Discounted quarterly, half-yearly and annual subscriptions paid in advance in a single solution are NOT refundable and are NOT automatically renewed.

Payment terms orders and deposit

For all orders confirmed by Exporta,but not paid by the customer within 1 month will be applied and retained a penalty of 50% on the total amount of the order, which will be deducted from the deposit and/or payments already received and the order will be consequently canceled.

Exporta also declines any responsibility for goods paid and not collected after the period of 6 months, unless otherwise agreed in writing with the buyer.

Right of withdrawal

Purchases on the Exporta website are subject to the regulation of Legislative Decree No. 206/05, dictated in the matter of distance contracts,in cases where the delivery of the goods takes place at the home of the buyer,as these purchases are completed outside the commercial premises.

The community legislation,more commonly known as the right of withdrawal, provides that this right is exercisable only by natural persons (consumers) who act for purposes that may be considered unrelated to their commercial activity. The right of withdrawal, therefore, cannot be exercised by legal persons and natural persons acting for purposes related to a commercial activity. The right of withdrawal also excludes purchases made by retailers or by subjects who for any reason purchase for resale to third parties.

What it consists of: the consumer has the right to withdraw from the contract within 10 working days from receipt of the goods,returning the goods subject to withdrawal to the seller,who will refund the price of the returned goods. The right of withdrawal does not apply to products delivered sealed, which have been opened by the consumer.

To exercise this right you must have the following documents and data:

* original invoice

* bank details on which to obtain the transfer

The communication must be sent by Registered Mail or certified mail ( exporta@pec.it ) A. R. within 10 working days from receipt of the goods,under penalty of forfeiture. The registered letter should be addressed to:

The registered letter must contain the declaration of wanting to exercise the right of withdrawal, indicating all the data mentioned above .

The goods must be shipped at the expenses of the customer.

Shipments

The ordered items will be shipped by express courier (DHL ) appropriately packed.

The goods travel at the risk of the buyer, therefore we advise customers that any claim for damage to the goods must be communicated immediately upon receipt of the goods, signing the receipt with reservation indicating the type of damage.

All goods travel insured and traceable.

Delivery times range from 1 to 3 working days for domestic shipments and from 3 to 7 working days for international shipments.

These times are to be considered purely indicative.

For any dispute, the Court of Rome ( Italy ) has jurisdiction.
